A former Deputy National Publicity Secretary of the All Progressives Congress (APC),Timi Frank, has alleged that the Chief Justice of Nigeria (CJN) Justice Tanko Muhammad, is secretly consulting with the Presidency ahead of setting up of the Supreme Court panel to hear the appeal by the presidential candidate of the Peoples Democratic Party, PDP, Alhaji Atiku Abubakar challenging the earlier ruling of the Presidential Election Petition Tribunal which declared President Muhammadu Buhari winner of the 2019 election.
Frank urged the CJN to stop unnecessary delay in constituting a panel to determine Atiku’s case based on the tradition of seniority and not “consulting or waiting on the advice of the presidency.”
the political activist said it amount to injustice for the CJN to delay the constitution of the 7-man panel more than a month after the presidential candidate of the PDP appealed the Presidential Tribunal’s judgement.
We are reliably informed of an unholy alliance between the CJN and the presidency which is causing the delay in constitution of the panel, such move is dangerous for Nigeria’s democracy.
“The CJN must respect the normal tradition of following the order of seniority in selecting the justices. Even all the times Bubari himself had approached the Supreme Court in the past, order of seniority was followed. The precedent is set contrary to the ongoing shopping for judges who will be favourable to the whims and caprices of General Buhari and the APC.
“If anything contrary to the tradition of order of seniority which we all know is allowed to happen, that will confirm that the CJN has bowed to the pressure from the presidency and that will also confirm the allegation made earlier by the CUPP.
“It is obvious that the judiciary under the current administration seems to have been caged but it is high time our judiciary showed courage. The whole world witnessed the courage showed by the Supreme Court in the United Kingdom recently. Even in Africa, Kenya’s Supreme Court has also proven to be independent when it recently nullified presidential election of a sitting president, Nigeria’s judiciary must prove its worth in this case.
“A situation where the CJN has to consult the presidency or the AGF before a panel is constituted does not show an independent judiciary,” Frank stated.
While calling the attention of the international community on the matter, the Bayelsa born activist said in a democratic system once justice is not seen to be given, anarchy and chaos will be the order of the day.
Frank also called on the former CJNs to call Justice Tank to order, to avoid playing politics but adhere to precedents laid by them.
“Nigeria is greater and more important than General Buhari and his cabal. I, therefore, call on the good people of Nigeria, the African Union (AU) and other International Community to ensure that the independence of the judiciary must remain sacrosanct and inalienable, and compel Justice Tanko to do the right thing,” Frank stated.
2023: Buhari may run for third term – Galadima
An estranged political associate of President Muhammadu Buhari and the National Chairman of Reformed All Progressives Congress, rAPC, Alhaji Buba Galadima, has declared that Nigerians should not be surprised to see the President contesting in the 2023 presidential election.
Galadima, now an ally of the Peoples Democratic Party, PDP, and its presidential candidate, Alhaji Atiku Abubakar, said that some forces will draft Buhari into the 2023 presidential race.
Speaking in an interview with the Sun, Galadima also claimed that President Buhari was confident enough to travel to Saudi Arabia on the eve of the hearing of petition, and appeal against his election by Atiku because he (Buhari) has already pocketed the judiciary, and feels that nothing will happen, and that he will be victorious at the court.
According to him, “I have never seen such a terrible situation like what we are witnessing in Nigeria today under the APC-led government of President Muhammadu Buhari. Not even during the colonial era, and the military period have Nigerians passed through these hard times.
“With Buhari in charge, it is like Nigerians have entered a one-chance bus. What is even surprising is that despite all the hardship, and suffering being inflicted on Nigerians, Buhari is not bothered. He doesn’t feel moved by the cries of hardship and sufferings, which his government has brought upon Nigerians.
“Now Buhari has travelled outside the country again. He has travelled to Saudi Arabia, and from there, he will go to the United Kingdom. Does that show the trait of a good leader? Buhari keeps on travelling across the globe while Nigerians are wallowing in poverty.
“He is not moved by all the hardship, and not only that, he feels so confident that his mandate is secured. If not, he would not have travelled to Saudi Arabia on the eve of the hearing of petition, and appeal against his election by Alhaji Atiku Abubakar, the presidential candidate of PDP.
“Buhari has already pocketed the judiciary, and he feels that nothing will happen, and that he will be victorious at the court. His government has destroyed the judiciary and this is very troubling for democracy, and our nation
“A lot of politicians will be disappointed. Only God knows what will happen between now and 2023. Buhari may even be drafted to join the 2023 fray by some of his aides and associates.
“Buhari may be drafted by those enjoying under his government. Buhari has always been drafted to contest elections, and I won’t be surprised if his supporters draft him into the 2023 race.
“But clearly, what these politicians jostling and talking about 2023 don’t know is that they are over-exposing themselves. They are exposing their weaknesses, and their opponents or political foes may use it against them.
“Nobody knows how 2023 will go. It is only God that knows. Anything can happen between now, and 2023.”
WILD CELEBRATION IN KENYA STREETS. —— Women celebrate as government legalizes polygamy
A new law that went into effect in Kenya this week makes it legal for a man to marry as many women as he wants. And a leading women’s group is applauding it.
President Uhuru Kenyatta signed the polygamy measure into law Tuesday, formally recognizing what has long been a cultural practice in the nation.
Parliament passed the bill in March despite protests from female lawmakers who angrily stormed out of the late-night session at the time.
The bill initially allowed the first wife the right to veto the husband’s choice of additional spouses. Male members of parliament successfully pushed to get that clause dropped.
“Marriage is the voluntary union of a man and a woman whether in a monogamous or polygamous union,” Kenyatta said in a statement. “The Marriage Act 2014 defines various types of marriages including monogamous, polygamous, customary, Christian, Islamic and Hindu marriages.”No limit on number of wives
The law legalizes polygamous unions, but does not provide an official limit on the number of wives a man can have.
The Federation of Women Lawyers, a powerful women’s rights group, applauded aspects of the bill and criticized others.
Polygamy already is a common fixture among many cultures in Kenya and in some other African countries.
The bill, the group said, is long overdue because polygamous unions were previously not regarded as equal to regular marriages.
“We are happy with the law because finally all marriages are being treated equally,” said Christine Ochieng, executive director of the nation’s Federation of Women Lawyers.
“All marriages will be issued with marriage certificates, including customary marriages. Before this, customary marriages were treated as inferior with no marriage certificates. This opened up suffering for the women because they could not legally prove they were married to a particular man. ”
First wife has no say
However, she said, the first wife should have a say in picking her husband’s co-wives.
“What we are not happy about is that now a man can marry another wife or wives without the consent of the first wife,” she said. “That section of the law is potentially open to abuse because a man can secretly marry other wives because he doesn’t need his wife’s consent to marry.”
But Jane Kimani, a Nairobi resident, said the bill is archaic and has no place in modern society.
“Polygamous marriages should not even be an issue today,” she said. “Kenya is moving backward instead of changing with the times.”
EFCC arraigns developer over Maitama alleged property fraud
The Economic and Financial Crimes Commission, EFCC, has arraigned Joseph Idakho alongside his company, Zamtrac Management and City Investment Limited
for alleged conspiracy, forgery and criminal breach of trust.
The duo were made to appear before Justice D. Z. Senchi of the Federal Capital Territory, FCT, High Court, Jabi, Abuja.
He allegedly defrauded one Hajiya Halima Babangida in a real estate development transaction that went awry.
EFCC spokesman, Wilson Uwujaren said this in a statement in Abuja.
Uwujaren explained, “Babangida alleged in a petition to the EFCC that she entered into an agreement with the defendant’s company for development of six units of detached houses of five bedrooms each, including boys quarters, at Plot, 2398 AO6, Cadastral Zone, Maitama District, Abuja, with her contribution being the land, while the defendant was to bear another cost of development.
“She claims that they had agreed to share the property equally at the end of development but discovered, to her chagrin, that the defendant commenced sale of the property even before completion without her knowledge or approval.
“Irked by this development, she allegedly probed further and discovered that Idakwo and one Aliyu Dasuki conspired and forged her signature on the documents which they used in selling the houses”.
Count one of the five-count charges read: “That you, Joseph Idakwo and Zamtrac Management and City Investment Ltd sometime in October 2017 in Abuja within the jurisdiction of this Honourable Court entrusted with dominion over the landed property at Plot 2398 A06 Cadastral Zone Maitama District, Abuja committed criminal breach of trust in respect of the said property when you sold part of the property to Suleiman Mohammad Chiroma in violation of paragraph 3.2.6 of the Property Development Agreement made on 20th January, 2017 between Hajiya Halima Babangida and Zamtrac Management and City Investment Ltd and you thereby committed an offence contrary to, and punishable under Section 312 of the Penal Code Law”.
But after the charges were read, the defendant reportedly pleaded not guilty to all the charges.
The prosecuting counsel, Offem I. Uket, asked for a trial date and prayed the court to remand the defendant in Nigerian Correctional Service custody, pending the commencement of trial.
However, the defence counsel, J. A. Atanawhemera, moved an oral bail application for his client.
In his ruling, Justice Senchi granted the defendant bail in the sum of N1, 000,000 with two sureties, who must have landed properties in Abuja, with Certificate of Occupancy.
He also ordered that the sureties must be residents of Abuja, and adjourned the matter to January 16, 2020 for trial.
